Paul: I believe that Part 15 Section 209 is also totally applicable. It says:
 
§ 15.209 Radiated emission limits; general
requirements.
(a) Except as provided elsewhere in
this subpart, the emissions from an intentional
radiator shall not exceed the
field strength levels specified in the
following table:

Why don't you think this section applies?
 
Also, the 3 meter limit is not for the antenna itself but rather for the sum of the transmission line (coax) and antenna as stated in Section 219: 
 
(b) The total length of the transmission
line, antenna and ground lead
(if used) shall not exceed 3 meters.
