The FCC does have minimum efficiency requirements for the tower installed at
a station.  This is determined by the field strength at a kilometer with a
kilowatt into the tower.  Different classes of stations have greater or
lesser requirements.  A station like WLW-700 requires a significantly larger
efficiency than a station like KFIR.  And, a local such as 1230, 1240, 1340
etc. has the least requirement.  Offhand, unless the previous 1370 version
had a tower somewhat greater than 1/4 wave, I'd think the 720 operation
doesn't meet the minimum.  However, a station on the low end of the band
does have an advantage.  WDDZ-550 does just fine with the 1/6 wave tower by
virtue of the great coverage at the low end of the dial.  Waviers of the
minumums are not unheard of, either.
