No they cannot. The rules are SUNRISE to SUNSET, no exceptions. KFUO has to shut off IBOC during the month of December at 4:30 p.m.; in January, they have to shut it off at 4:45 p.m. During the hour of illegal IBOC operation, KFUO intereferes with the coverage areas of KKOW 860 Pittsburg, KS (which doesn't power down to 1 kW until 5:15 p.m. in December) and WHAS 840 Louisville, KY (which is a 50 kW Class A; it has to be protected to 300 miles, and Louisville is only 240 miles from Clayton). I'm right on this one, both you and Chuck (and the FCC) are wrong.
