Further, one needs to distinguish between something which is actually
published / recorded with the intent of other than merely private
distribution versus 'commercial' writings or recordings. With the
latter, there is an implied copyright with publication and recording
via some vehicle available for public distribution on some scale. 

Publication or recording is still somewhat murky as there's not yet a
lot of precedent for use of a lot of internet/computer media by private
individuals or groups.
