According to the FCC's IBOC Notification Procedure, document DA-03-831 dated March 20, 2003, downloadable from the FCC website at http://www.fcc.gov/mb/audio/digital/index.html

"An AM station with authority to operate between 6 a.m. and local sunrise (pre-sunrise hours) and between local sunset and 6 p.m. (post-sunset hours) may operate its hybrid IBOC system during those periods."

It certainly appears that WBZ (and anyone else) is operating legally, if they shut off the IBOC at 6 pm.

They should be turning off the IBOC at local sunset, not 1800. As defined by FCC rules, DAYTIME is defined as SUNRISE to SUNSET only.
