Don,

The HD interfering with local stations is going to be a big issue. I
hope these stations that are interfered with complain. 
But I don't see any way the HD cannot interfere. Unless the interfering
station shuts off the HD, the QRM will be there. I presume the
interfering station could cut the power way back on the sidebands, but
then the HD would not do them anygood as they would not have any
coverage. It is like a dog chasing his tail, no way to win.
