This looks legit.  There are a bunch of other reports out there,
including Business Week magazine, that corroborate this.

General feeling is that it will indeed pass FCC muster on antitrust concerns.

The Wall Street Journal said this much on Saturday:

"XM Satellite Radio rose 1, or 7.7%, to 13.98, and Sirius Satellite
Radio gained one cent, or 2.8%, to 3.70, both on Nasdaq. Bear Stearns
said a proposed merger of the satellite broadcasters could likely pass
the regulatory hurdles, which would probably push them to attempt such
a move."
