Item from AWR-Europe/Wavescan:

Netherlands:  Marcel Rommerts - the Netherlands - has interesting
information about Hitradio Veronica.

The WRTH 96 lists under the Netherlands the third MW frequency for Hitradio
Veronica as active, but this is not true.  The 5 KW transmitter listed in
the WRTH as being in Echt is not in use.  The location mentioned to me by
the NOZEMA, the organization that will operate it, was in fact Stein.

NOZEMA also told Marcel that there are serious coordination problems with
the Belgian and German authorities, that have objected to the activation of
this frequency in the south of the Netherlands.  It does not seem that these
will be solved in the very near future.

You may remember from a few years ago that Hitradio Veronica won a tender
for the use of a whole network of low power mediumwave frequencies but they
will not use more that the three mentioned in the WRTH.

It is expected that these unused frequencies will be given back by Hitradio
Veronica to the government, who plans to organize a tender for 'rest
frequencies' (including longwave 171 and low + high power FM) again in 1997.
Frequencies will go to the highest bidder.

After a change in the law, local and regional commercial radio is now
allowed in the Netherlands.  However, to obtain an ether frequency they
probably have to follow the tendering procedure mentioned above.  They are
free to sign contracts with any cable system they want.

Look for a simulcast of 1060 KPAY CHICO, CA and 1290 KHSL CHICO, CA as the
stations go through the final part of a multi-station transaction.  The
general plan is to allow am 1050 in San Francisco to go full 50kW
non-directional day and night, leased from the Mexican stations that have
1050 as a clear now.  So the company owning the SF station bought 1060 in
Chico, Chico will eventually go dark and move to 1290, leaving 1050 a big
hole in which to jump right into.  The station that used to own 1060 was
McCoy Broadcasting, not sure of the new owner but look for the simulcast if
you are in the west now.

Thanks to everybody who helped me to solve unid-stations.  I was especially
happy to know that "Radio India" 610 kHz was CKTB as this is a rare stn in
Scandinavia.  The 1430 kHz mystery was KBRC Mt. Vernon, Wa. and 1380 WFCL
Clintonville, Wi.

MAR 21 PM didn't really do any DXing as such but did tune around for about
an hour.  Spanish stations booming in everywhere - Mark C made a trip to the
pier so he will fill you in on this evening.  MAR 22 PM nothing exciting
that I can remember but didn't do too much.  MAR 23 visit from Dave Schmidt
and Ben Dangerfield saw so-so conditions, Western Sahara-711 absolutely
booming, stronger than WOR, Senegal again good, T&C-532 off and is still off
but nothing but Spain, ended off the evening with a nice signon from VOA Sao
Tome-1530 at 0259 with "Yankee Doodle" - when I switched from 7340 to 1530
Ben & Dave yelled "There it is" in unison so quick that I hadn't even heard
it yet! MAR 24 2205z band already covered with signals unlike last night
when I had guests, Saudi-648 nice at 2252.  MAR 25 0000-0400z on NRC Ham Net
and when I got off didn't seem to be much going on so went to bed early. MAR
25 2300z a mixed bag, some signals on low and mid band with the best bunched
in the 700/800s and 1100s, although Morocco-702 good again and had possible
Gambia-648, spent a good bit of time on 531 but other than Algeria up
briefly was all Spain.  It is nice to see T&C-532 off and hopefully they
will stay off.  Worked an interesting Amateur Special Events station today
on 30 Meters - GB60BBC - which is commemorating the 60th anniversary of some
aspect of the BBC - World Service maybe since I think the BBC itself is
older than that.  MAR 26 2310z Morocco-702 boiling in and //774, 747 a
complete jumble, at least 3 stations with Canaries generally best. 648
carrier but no audio, 531 a mixture of Algeria/Spain as T&C still off.
Azores 693/837 good playing Dixieland jazz.  Lots of strong signals from
Southern Europe/North & West Africa.  2342 648 with some audio, man/woman in
??, seemed all talk, no music heard, not sure of language.  MAR 27 0015
finally IDed 648 tonite - RNE, but this didn't seem //684 earlier.  MAR 27
PM  - 2330 lots of very strong signals between 600 - 1150 plus Belgium on
1512.  A bit later seemed to have cooled off and nothing new noted.

Trans-Atlantic

       was completely dead as I tried 153 - not a signal to be heard.

       not like anything ever heard on Libya but 1251 not in for // check.
       Senegal-765 also in well.  This frequency needs close attention.

"FCC Nixes Nighttime Power for WPMZ" - Radio World, 3/20/96

East Providence, R.I. - Last month the Federal Communications Commission
(FCC) denied a Special Temporary Authority (STA) to Bear Broadcasting's
WPMZ(AM) here, ending the station's quest to continue nighttime operation of
250 W at 1110 kHz.

    What makes this notable is the station had been broadcasting at night
for nearly a decade without authorization and was creating widespread
interference to clear-channel station WBT(AM) Charlotte, N.C., even though
little or no objection was raised by listeners.
    What follows is a curious story of forms, calls, communiques and
complaints that took a decade to iron out.

HISTORY

    The timeline began in 1985, when Bear's predecessor, East Providence
Broadcasting, owned the station; known previously as WWRX and WHIM before
the present-day calls.
    In 1985, East Providence Broadcasting claimed to have received FCC
authorization for 250 W nighttime power in the form of an Order to Show
Cause.  A letter sent to the station from the law firm of Hogan and Hartson
confirmed the station could begin 24-hour operation.  East Providence
commenced night operation on Jan. 1, 1986.
    According to the original June 30, 1993, STA request, the general
manager and president of East Providence Broadcasting stated they had spoken
with a Mr. Rosenberg at the commission several months later, who confirmed
the authorization to broadcast at night.
    Timothy Z. Sawyer, technical consultant to Jefferson Pilot
Communications (owner of WBT), commented, "The station has never been able
to produce anything that indicates authorization.  Anything the station has
submitted has been the first sheet of a Show Cause order, which is like the
instruction sheet - it doesn't have their call letters on it, it has no
indication that it pertained to their station."
    In 1988, Bear began negotiations to buy WHIM.  No complaints of
interference had been filed and no proceedings were pending with regard to
WHIM's night operation.  Bear received FCC approval to take over the station
on Jan. 24, 1989.
    In 1992, a phone call to WHIM prompted Bear to investigate the validity
of its nighttime operation.  It was discovered the FCC had no record of
WHIM's night authorization and a channel allocation study revealed such
entitlement was unlikely to begin with, due to the Class I-B status of
Jefferson-Pilot's WBT(AM).

FIRST REQUEST

    WHIM initially requested continuing night operation on 1110 kHz, but
proposed these options: priority ranking to migrate to the expanded AM band,
or split-frequency operation where WHIM would move to the first adjacent
frequency of 1120 kHz at night.  On July 20, 1993, the FCC's May Bradfield
issued a one-paragraph telegram to Bear, denying the STA.
    Bradfield cited the station's Class II (Class D) status and lack of
records authorizing night operation.  Bradfield also requested a detailed
engineering study and filing of FCC Form 301 if WHIM desired nighttime
operation.  Copies were forwarded to James Burtle, chief of the AM Branch,
Audio Services Division; Bear's attorneys and the Engineer in Charge (EIC)
at the FCC's Boston Bureau.

NO SUSPENSION

    While the telegram denied temporary authorization, nowhere did it say in
plain language that WHIM was to suspend nighttime operation.  WHIM continued
to stay on the air after sunset, changed calls to WPMZ and, pursuant to an
LMA, programmed a Spanish-language format.
    Sawyer notes the format caused some confusion as to the signals' origin.
    "We received reports as far as South Carolina.  We weren't sure where it
was coming from; whether it was a Cuban station or anywhere in Central
America."
    On Feb. 7, WPMZ again applied for 250 W nighttime operation, "or some
lesser amount that the commission may determine."  The STA was filed as a
result of a Notice of Violation by the Boston EIC, requiring a reply within
10 days.  On one occasion witnessed by the Boston District Office, WPMZ ran
a full 5 kW after sunset.  The station had been operating at night for over
a decade.
    WPMZ continued to operate, believing the FCC's 1993 denial was issued
"without the apparent knowledge of any supervisory commission official ...
not properly authorized and not an official response," even though copies
were submitted to Burtle, Bear's attorneys and the Boston EIC.
    The new STA request contained a disturbing passage that claimed oral
permission was given by an unnamed FCC official to continue nighttime
service until the staff could review the matter.  Such a "back room deal"
would have been in violation of the commission's own public regulations and
would not have been binding in the first place.

DISPUTES

    On Feb. 8, Carter Broadcasting -- owner of crosstown WRIB(AM) -- filed
an Opposition to Request.  In the opposition, Carter called WPMZ a "pirate"
station, claimed Bear knowingly and willingly violated the commission's
rules and was actually trying to obtain a waiver of established FCC rules
disguised as an STA.
    The opposition accused Bear of not practicing "normal due diligence" for
not investigating FCC files to determine parameters of operation.  Another
part addressed Bear's interpretation of the original denial in 1993 and
subsequent post-sunset operation.
    The opposition also accused WPMZ of convincing WRIB's clients its night
signal was superior to the Carter station's, succeeding in drawing business
away from WRIB with "illegal nighttime activity."

STRIKE TWO

    The FCC issued a second denial to Bear's STA on Feb. 16, this time
including the order to cease and desist nighttime operation immediately.
    In the end, the crux of the issue was WPMZ's license: authorization for
daytime operation only.  The commission's judgement stated "... the burden
rested with Bear to officially ascertain WPMZ(AM)'s nighttime authority
prior to initiating such service."
    Following receipt of the denial, Mark N. Lipp, Counsel to Bear
Broadcasting, notified the FCC that WPMZ was terminating nighttime
operations immediately.
    But Bear is not down and out.  Lipp tells RW that other options are
being explored to return WPMZ to the air at night.
    "We're in the process of deciding whether there are any other options to
do that.  We don't have anything nailed down but we are thinking about it.
We are trying."

...
Editorial comment..  and we wonder why the AM band is so screwed up....  Why
does WPMZ even still have a license?  Why aren't they facing even a minimal
fine?  As long as this kind of blatant violation of the technical
regulations can go totally unpunished, the band is doomed.

On a totally different subject....  Messages on Compuserve suggest that
WNTA-1150 Rockford, Illinois has moved to 1330, surrendering the license for
1150.

Finally, one of my MT readers has forwarded a faxed verie from WJDM-1660.
(it may be that the fax was simply the reader's way of making a copy).  The
verification states the station is using a Harris DX-10 transmitter at 10kW
day, 1kW night (not a surprise).  It shares a single 80-foot (?!) tower with
the 1530 transmitter.  They plan to continue operating 1530 until its
license expires.  (CE Don Neumuller doesn't say when that happens).  While
WJDM is theoretically non-directional, a computer-prepared plot of their
daytime 5mV/m contour shows some marked lobes.  I'm sure it's no surprise
the biggest are out to sea south of Long Island, and along Long Island
Sound.
